This Acceptable Use Policy (“AUP”) sets out what you may and may not do with the Cloack Service. It is incorporated into the Terms of Service. You are responsible for your own use and for the use by anyone acting on your behalf.
1. General prohibited uses
- Any unlawful, fraudulent, or deceptive activity.
- Infringing intellectual-property rights or misappropriating data.
- Distributing malware, phishing, or attempting to breach security.
- Harassment, hate speech, or content that is illegal in the relevant jurisdiction.
- Circumventing rate limits, platform policies, or messaging-provider terms (e.g. Telegram, Meta, TikTok).
2. Forex, CFD, and financial-services marketing
The Service may be used to market financial products such as forex and contracts for difference (CFDs). Because these products are heavily regulated, you are solely responsible for:
- Holding, or partnering only with entities that hold, the licences and authorisations required in every jurisdiction you target.
- Displaying accurate risk warnings (for example, that trading carries a high risk of losing money) as required by the applicable regulator.
- Honouring jurisdiction restrictions — not soliciting residents of countries where the product or promotion is prohibited or restricted (including bans on marketing leveraged products to retail clients).
- Making no misleading claims about returns, guarantees, or past performance, and complying with financial-promotion rules.
Cloack is a software tool, not a broker, adviser, or introducer, and does not endorse or verify any financial offer run through the Service. Non-compliant financial marketing is prohibited and may result in immediate suspension. [Placeholder — align with counsel and the specific regulators in scope.]
3. Outbound messaging and consent
When you send outbound or automated messages (including via Telegram bots, broadcasts, and conversational funnels), you are solely responsible for:
- Obtaining a valid legal basis and any required consent to contact each recipient.
- Providing a clear and working opt-out mechanism and honouring opt-out requests promptly.
- Complying with anti-spam and electronic-communications laws (e.g. GDPR/ePrivacy, CAN-SPAM, and local equivalents) and with the terms of the underlying messaging platforms.
- Not sending unsolicited bulk messages, and not scraping or importing contacts without a lawful basis.
4. Enforcement
We may investigate suspected violations and may suspend or terminate access, remove content, or report unlawful activity to authorities. We may act immediately where use poses a risk to the Service, other users, or third parties.
